Lipitor MDL Established in South Carolina

Lipitor Lawsuit Loan - Settlement Cash AdvanceThe U.S. Judicial Panel on Multidistrict Litigation recently ruled that all federal Lipitor lawsuits will be consolidated into multidistrict litigation. The order was handed down on February 18, stating that all complaints will be transferred to the U.S. District Court for the District of South Carolina, under the direction of U.S. District Judge Richard M. Gergel.

MDL 2502 has centralized at least 56 product liability lawsuits, including 14 cases that had been filed in South Carolina District court. All plaintiffs claim that Lipitor manufacturer, Pfizer, failed to provide adequate warning on the increased risk of diabetes from Lipitor.

Another 170 Lipitor complaints filed in other federal courts are expected to be moved into the MDL in the coming weeks.

Plaintiffs may wait years for a resolution

Consolidating the cases for coordinated pretrial proceedings helps to eliminate duplicate discovery, prevent inconsistent pretrial rulings, and conserve the resources of both parties and the courts. However, it also means that plaintiffs have just begun a litigation process likely to last years.

Lipitor, a drug designed to help lower a patient’s cholesterol, has proven very profitable for Pfizer, generating $125 billion in sales since 1996. It’s likely that thousands, or even tens of thousands, of complaints may be added to the MDL in the coming months and years. The overwhelming popularity of the drug will likely cause a number of delays in the litigation process.

The U.S. JPML originally denied a similar request to establish a Lipitor MDL in July 2013, ruling that there were not enough cases to warrant the proceedings. However, plaintiffs filed another motion in October 2013, which was approved last week.
